The lawsuit was filed on Monday in Nassau County Supreme Court.

The 'Milkaholic' ad originally aired during the Super Bowl and featured a group of talking babies. The most memorable part of the ad featured a baby named 'Lindsay', poking its head on screen and slurring the phrase, "Milk-a-what?".

According to the New York Post.com report, Lohan's attorney, Stephanie Ovadia said, "Many celebrities are known by one name only, and E-Trade is using that knowledge to profit."
