LOS ANGELES -- Prosecutors decided against filing charges against Sen. John Kerry's 36-year-old daughter, who was arrested last week in Hollywood on suspicion of driving under the influence.
"We've declined to file charges in that matter due to insufficiency of the evidence," Frank Mateljan of the Los Angeles City Attorney's Office said in reference to Alexandra Forbes Kerry.
Kerry was pulled over for a traffic stop around 12:40 a.m. in Hollywood and then arrested, according to the Los Angeles Police Department's Hollywood station.
Kerry refused to take a field sobriety test.
At the police station officers conducted a formal blood alcohol test, which showed a level of .06, according to published reports.
The 36-year-old film producer and director was booked for misdemeanor DUI and released on $5,000 bail, police said.
Under California law, the legal limit is .08, but a driver can still be prosecuted -- even under a .08 reading -- if the vehicle is being operated unsafely due to alcohol.
Massachusetts Senator John Kerry, the democratic nominee, was defeated in the 2004 presidential election by incumbent President George W. Bush.
Kerry's rep says, "Senator Kerry supports his daughter and will have no further comment on a private matter."
Kerry has two daughters, Alexandra and Vanessa, and three stepsons.
