YUBA CITY, Calif. - A Northern Californian physician faces charges of driving under the influence after crashing into a car on his way to work.

His attorney says he intends to plead not guilty and says his client had not been drinking that morning.

Igwegbe -- a gastroenterologist -- was scheduled to perform five procedures on May 25, on the day of the crash.

According to court documents, other drivers noticed Igwegbe's 2006 Honda Accord weaving at about 80 mph before his vehicle crossed the center line and hit a car causing injuries to its driver that a lawsuit says will result in "some permanent disability."

The California Highway Patrol says Igwegbe refused to take a breath test after the accident. A blood test found that his blood alcohol level was 0.13, 5 point over the legal limit.

Igwegbe is free on $75,000 bail. His arraignment will take place on Oct. 18.
