LOS ANGELES ( KTLA) -- The L.A. Zoo can move forward with its plan to open a controversial new elephant exhibit next week, a judge has ruled.

However, the judge also ruled that a lawsuit filed by the late actor Robert Culp to stop the expansion will continue.

Animal rights activists and the actor filed the lawsuit in August 2007 however, he died in March of this year.

The suit alleges that the zoo is guilty of animal abuse and that the $42 million exhibit is a waste of taxpayer money because it is too small for the three elephants.

The case was dismissed and then an appellate court sent it back for trial.

The exhibit is scheduled to open Dec. 16.
