LOS ANGELES -- Lindsay Lohan's 2007 DUI case may have plea bargained so quickly because the cop who found the cocaine in her possession reportedly mistook it for a breath mint and tossed it in the trash.
A Santa Monica Police report from Lohan's July 2007 DUI arrest states that the officer found a "folded Clinique sun care card with an unknown substance caked on to the surface of the card in Lohan's right rear pocket," TMZ is reporting.
The report goes on to say that "some of the white substance fell to the floor" and the officer used his foot to see what had fallen, but "thought nothing of it."
"I did not recognize the substance attached to the card and initially thought the substance was a wet crushed breath mint," the report states.
The officer tossed the card into the jail trash can and then began to realize the substance resembled cocaine, according to the report, which states the officer recovered the card from the trash.
After about 2 minutes in the trash, the card was placed into an evidence envelope, TMZ is reporting. The cop also reportedly scooped up the white substance that had fallen to the floor and placed it in a separate evidence envelope.
Lohan lost control of her Mercedes SL65 and crashed into some shrubs in July 2007, following a night of partying. A urine test later indicated she had cocaine in her system at the time. In August, 2007, the "Mean Girls" actress pleaded guilty to misdemeanor drug charges and no contest to three driving charges. She was sentenced to three years probation, spent 24 hours in jail and was also ordered to attend an 18-month alcohol education program for drunk driving, reckless driving and driving under the influence of cocaine.
Lohan is currently wearing a court-ordered SCRAM bracelet as a result of a probation violation in the case.
The bracelet checks for traces of alcohol in the air above the user's skin. Any effort to tamper with the 10-ounce device immediately sends out an alert. The monitoring company reports to the Los Angeles County Probation Department and the Superior Court judge in Beverly Hills who is hearing Lohan's case.
Judge Marsha Revel ordered Lohan to wear the bracelet following a May 24th hearing and told her not to consume alcohol. If Revel determines a violation has occurred, she could order the immediate revocation of the actress' $200,000 bail and send Lohan to jail.
