SANTA ANA -- A convicted rapist and child molester has been released from custody after a judge rejected a request by prosecutors to keep him locked up.
Frederick Davison, 40, is now living with a former girlfriend and her boyfriend in Topanga Canyon.
He will be required to register as a sex offender within five days of release and be listed on the Megan's Law Web site.
The Orange County District Attorney's office still believes Davison poses a danger to the community, spokeswoman Farrah Emani said.
Davison raped a 21-year-old student after meeting her on a sidewalk outside a restaurant in Huntington Beach in 1992.
Eleven months later, he was accused of molesting a 9-year-old girl.
He was convicted on one felony count of forcible rape and he was sentenced to 13 years in state prison for the Huntington Beach rape.
Davison then pleaded guilty in Los Angeles County to a felony count of lewd acts on a child.
He was sentenced to eight years in state prison to be served concurrent with the Orange County rape sentence.
After his release in 2002, the Orange County District Attorney's Office asked the court to declare him a danger to society under the sexual violence laws.
He was placed at Coalinga State Mental Hospital in 2005.
But now authorities have determined he does not have a mental disorder that would allow the state to hold him.
